Prada Gift Card

1. These terms and conditions (the “Terms and Conditions”) regulate the purchase and use by the Buyer (as defined below) of a gift card (the “Gift Card”) issued by PRADA, as defined in article 21 below.

 

2. The Gift Card - which may be purchased at any  store of the Prada Group (the “Prada Group Store”) or, if applicable, at the online stores of the Prada Group (the “Website”), by paying the cash equivalent of its face value - is a bearer instrument. Its face value corresponds to its purchase price (the “Initial Availability”) and may be used:

(i) exclusively in Prada Group Stores based in the country of purchase; or
(ii) on the Website by entering the unique numerical code identifying the Gift Card shown on the Gift Card itself.

The Gift Card cannot be used for purchases at Prada Group Stores located outside the national territory of the country in which it was purchased or at third-party multi-brand shops, both physical or online, at PRADA franchisees, department stores and duty-free shops.

 

3. The Initial Availability, prepaid and associated with the Gift Card, activated at the time of its purchase, (i) cannot exceed the maximum amount from time to time indicated by the applicable regulations containing the limitations on the use of cash or bearer instruments; (ii) can only be used for the purchase of products sold by PRADA (the “Purchase”); (iii) can only be used under the conditions set forth in these Terms and Conditions.

 

4. The Gift Card is not a credit or debit card and it cannot be recharged with additional funds or sums, nor can it be used to withdraw cash.

 

5. The Gift Card may be used by any person legitimately in possession of it (the “Cardholder”).

 

6. To use the Gift Card, the Cardholder must present it at the time of the Purchase at the Prada Group Store or, if the Purchase is made on the Website, the Cardholder must enter the unique numerical code identifying the Gift Card shown on the Gift Card itself.

 

7. The Gift Card may be used until the Initial Availability associated with it is exhausted and not beyond this amount. The Initial Availability will be progressively reduced by the amount corresponding to each Purchase (the “Residual Availability”).

 

8. The Initial Availability and the Remaining Availability of the Gift Card may be used in one or more instalments, for one or more Purchases, provided that the other provisions of these Terms and Conditions are complied with.

 

9. No interest or other proceeds and benefits shall accrue or be due, paid, credited or recognized on the Initial Availability or the Residual Availability of the Gift Card. The Gift Card is in no way usable when its Residual Availability reaches a balance of Euro 0 (zero).

 

10. The Gift Card cannot be returned to PRADA and is never redeemable for cash or any other means of payment.

 

11. If the value of the products chosen from time to time for the Purchase exceeds the value of the Initial Availability or the Residual Availability, the Buyer shall supplement the difference by using another payment method among those accepted by PRADA. For sake of completeness, please note that Cardholder could perfect any Purchases (as infra defined) also with the other payments instruments made available by Prada at Prada Group Store or on the Website, as the case may be.

 

12. Purchases made with the use of a Gift Card are subject to the Terms and Conditions, the regulatory provisions in force at the time of the Purchase, PRADA’s sales and return policies and the Conditions of Online Sale for Purchases made on the Website.

Any Purchases made with the Gift Card and subject to a refund request, following return due to defects or discretionary choice of the Cardholder, shall be refunded with the recognition of a credit equal to the value of the purchased product (so-called store credit, which shall be recognized in accordance with the relevant terms and conditions), and never in cash.

It shall also be possible to replace the product object of the first Purchase with another product sold by PRADA. If the price of the product object of the first Purchase is higher than the price of the product received in substitution, a credit equivalent to the price difference between the two products shall be granted. If the price of the product object of the first Purchase is lower than the price of the product received in substitution, the Cardholder shall pay the price difference.

In any case, no cash refund of any price difference between the two products is ever granted.

Terms and Conditions do not affect the further hypotheses of replacement of the product object of Purchase in case of defects and faults, which are not regulated by these Terms and Conditions.

 

13. The Gift Card is valid for 1 (one) year from the date of its activation. The expiration date of the Gift Card is the date indicated on the Gift Card itself.

 

14. In the event of loss, theft, damage or destruction of the Gift Card, PRADA will replace the Gift Card at its own discretion and provided that the following conditions are met: (i) submission of a report of the event for which the replacement is requested to the competent authorities; (ii) communication to PRADA of the complete unique code of the Gift Card.

 

15. In case of replacement, a new Gift Card will be issued with a balance equal to the Residual Availability of the replaced Gift Card existing at the time of replacement. The replaced Gift Card will be blocked.

 

16. No statement of account or any other information regarding the Gift Card and/or the Residual Availability will be sent to the Cardholder. The Cardholder may obtain information on the Residual Availability at one of the Prada Group Stores located in the country where the Gift Card was purchased or by contacting the Customer Service.

 

17. PRADA reserves the right to rectify the Residual Availability of the Gift Card if it discovers material accounting or transcription errors. PRADA also reserves the right to block the Gift Card or to revoke it if it suspects its use for fraudulent or illegal activities. For information and requests for clarification, the Cardholder may contact the Customer Service.

 

18. PRADA shall in no event be liable, for any reason whatsoever, for damages of any kind, direct or indirect, resulting from loss, theft, damage, destruction or any unauthorized, fraudulent or unlawful use of the Gift Card.

 

19. These Terms and Conditions shall be governed by the law applicable in the country where the Gift Card was purchased and any dispute regarding their application and interpretation shall be submitted exclusively to the court of the place where the Gift Card was purchased, without prejudice to the mandatory rules of law that may be applicable. Alternatively, the Cardholder may initiate one of the procedures for the out-of-court settlement of disputes, if provided for by applicable law. To this end, the Cardholder may use the online platform made available by the European Commission, which can be accessed through the website https://ec.europa.eu/odr.

 

20. The Cardholder, in accordance with the applicable law and/or tax regulations, undertakes to fulfil any tax obligations that may arise from the possession of the Gift Card and/or the making of each Purchase.

 

21. Please note that the activity related to the issuance by PRADA of Gift Cards is covered under the exclusion related to instrument-based services that can only be used to purchase products or services on the issuer’s premises or within a limited network of service providers bound by a commercial agreement with the issuer pursuant to article 3(k), point (i) of Directive 2015/2366/EU.

 

22. PRADA shall mean the Prada Group company operating the Prada Group Stores, or conducting Distance Selling, in the country where the Gift Card is purchased.

In relation to each of the territories listed below, PRADA is to be identified with the following companies:

a. Italy: Prada S.p.A., with registered office in Italy, via Antonio Fogazzaro 28, 20135 Milan;
b. Spain: Prada Spain S.L., with registered office in Spain, calle Serrano 23, 28001 Madrid;
c. Germany: Prada Germany GmbH, with registered office in Germany, Residenzstrasse 10, D-80333 Munich;
d. UK: Prada Retail UK Limited, with registered office, 17-18 Old Bond Street, London W1S 4PT;
e. France: Prada Retail France S.a.s., with registered office in France, Avenue Matignon 18, 75008 Paris;
f. Portugal: Prada Portugal, Unipessoal Lda, with registered office in Portugal, Avenida da Liberdade, n. 206 and 210, 1050 Lisbon;
g. Greece: Prada Hellas Single Partner Ltd., with registered office in Greece, Voukourestiou street 17, Athens;

Nominative Store Credit Prada

1. These terms and conditions (the “Terms and Conditions”) regulate how PRADA, as defined in article 7 below, may issue the so-called Store Credit, as described and defined below, as well as the characteristics, the modalities of use for the subsequent purchase of another Product and the terms of validity of the Store Credit.

 

2. The Terms and Conditions apply in the event of a request for replacement (if the price of the replaced Product is higher than the price of the new Product) or return (also related to the exercise of the right of withdrawal for purchases made through Distance Selling tools) of a product sold by PRADA (the “Product”) and purchased by a customer already registered in the CRM of PRADA (the “Customer”) at any store or outlet of the Prada Group (respectively “Prada Group Store” and “Outlet”) or, if applicable, at any online stores of the Prada Group (“Website”), or via other distance selling tools adopted by PRADA (“Distance Selling” which include the Website).

 

3. In the event of a request to return a Product for which proof of purchase (invoice or commercial document) has been provided, the Customer shall have different options depending on the type of purchase made:

 

3.1. Purchase at a Prada Group Store or Outlet:
The Customer may alternatively request:

(i) the exchange of the Product for another Product;
(ii) the issuance of a Store Credit (as defined below).


3.2. Purchase via a Distance Selling tool
:
The Customer may alternatively request:

(i) the refund of the price paid;
(ii) the exchange of the Product for another Product;
(iii) the issuance of a Store Credit (as defined below).

In the event of defects or lack of conformity of the Product and due to causes not attributable to the Customer, the latter may request the repair of the Product as an alternative to the replacement or refund of the price paid (pursuant to Article 130 et seq. of Italian Legislative Decree no. 206/2005, as amended and supplemented - the so-called “Consumer Code”), or to the issue of a Store Credit (as defined below).

The Customer’s acceptance of the Store Credit in the event of a defective or non-conforming Product shall not be cumulative with any of the other remedies described above and implies the waiver of any further legal and/or conventional warranty provided by law or made available by PRADA.

 

4. Store Credit


4.1. Within 14 (fourteen) days from the purchase of a Product at a Prada Group Store or an Outlet, or through Distance Selling, the Customer may request at any Prada Group Store (if the purchase took place in a Prada Group Store), or Outlet (if the purchase took place in an Outlet) in the same country of purchase of the aforesaid Product, the issuance of a store credit registered in the Customer's name, with a nominal value in Euro corresponding to the price of the returned Product (respectively, the “Store Credit” and the “Initial Availability”).

In the event of the return of a Product purchased via Distance Selling, the Customer may also request a refund of the price of the Product, by crediting the same payment system used for the purchase, if the Customer does not accept to receive a Store Credit instead of a refund or does not intend to replace the Product with another Product of his liking.

 

4.2. Store Credit:

(a) may only be issued upon presentation by the Customer of valid documentation justifying the purchase of the Product;
(b) must be used within 1 (one) year from its issue, which may be extended as indicated in paragraph 4.3 below;
(c) may be used to purchase other Products in the manner set out below:

(i) Store Credit issued upon return of the Product purchased at a Prada Group Store: exclusively at other Prada Group Stores in the same country where the Store Credit was issued,
(ii) Store Credit issued following the return of a Product purchased at an Outlet: only at Outlets in the same country in which the Store Credit was issued,
(iii) Store Credit issued upon return of the Product purchased via Distance Selling: at Prada Group Stores and through the Distance Selling tools managed by PRADA, subject to the Customer’s registration in PRADA’s CRM;

(d) is not transferable to, nor can it be used by, anyone other than the Customer holder;
(e) is not a credit or debit card and cannot be recharged with additional funds or sums, nor can it be used to withdraw cash and no interest or other income or benefit shall accrue or be due, paid, credited or recognized in respect of the cash equivalent of Store Credit;
(f) In order to benefit from it, the Customer must be registered with the PRADA CRM;
(g) may be used, in one or more instalments, for one or more purchases of Products, until the Initial Availability associated with the Store Credit is exhausted and not beyond that amount, and in accordance with the further provisions of these Terms and Conditions. The Initial Availability shall be progressively reduced by the amount corresponding to each further purchase of Products (the “Residual Availability”);
(h) once issued, it cannot be returned to PRADA and it is never refundable in cash or by any other means of payment.

 

4.3. The credit position connected to the Store Credit is automatically closed when the relevant Residual Availability reaches a balance of Euro 0 (zero) or if it is not used within the term of 1 (one) year from its issue, subject to any extensions granted by PRADA.

 

4.4. If the value of the Products chosen for purchase exceeds the Initial Availability or the Residual Availability of the Store Credit, the Customer shall make up the difference by using another payment method chosen from those permitted by PRADA.

 

4.5. In case of return of Products purchased using a Store Credit, the Customer shall only be entitled to the reinstatement of the Store Credit for the amount corresponding to the price of the returned Product.

 

4.6. In the event of loss, theft, damage or destruction of the Store Credit, PRADA will replace the Store Credit at its own discretion and block the previous Store Credit, after identifying the Customer, the Store Credit being nominative.

 

4.7. No statement of account or any other information relating to Store Credit and/or Residual Availability will be sent to the Customer. The Customer may obtain information about the Store Credit Residual Availability at Prada Group Stores or Outlets located within the national territory of the country where it was issued or by contacting the Client Service.

 

4.8. PRADA reserves the right to rectify the Residual Availability of Store Credit if it finds material accounting or transcription errors. It also reserves the right to disallow the use of Store Credit if it suspects its use for fraudulent or illegal activities. For information and requests for clarification, the Customer may contact the Client Service.

 

4.9. PRADA shall in no event be liable, for any reason whatsoever, for damages of any kind, direct or indirect, resulting from loss, theft, damage, destruction or any unauthorized, fraudulent or illegal use of Store Credit.

 

5. These Terms and Conditions shall be governed by the law applicable in the country in which the Store Credit was issued and any dispute as to their application and interpretation shall be submitted exclusively to the court of the place where the Store Credit was issued, without prejudice to any applicable mandatory law. Alternatively, the Customer may initiate one of the out-of-court dispute settlement procedures, if provided for by applicable law. 6. The Customer, in accordance with applicable legislation, including tax legislation, undertakes to fulfil any tax obligations that may arise from the possession of Store Credit.

 

7. Please note that the activity related to the issuance by PRADA of Store Credit is covered under the exclusion related to instrument-based services that can only be used to purchase products or services on the issuer’s premises or within a limited network of service providers bound by a commercial agreement with the issuer pursuant to article 3(k), point (i) of Directive 2015/2366/EU.

 

8. PRADA shall mean the Prada Group company operating the Prada Group Stores, and/or Outlets, or carrying out Distance Selling, in the country where the Store Credit is issued.
